Terms of Service

By purchasing, activating, or using any Impulse Tech Inc. product or service — including the IMPACT sensor device and the Impulse mobile application — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our products or services.

These Terms constitute a legally binding agreement between you and Impulse Tech Inc. ("Impulse," "we," "us," or "our").

Impulse provides a hardware sensor device ("IMPACT") and a companion mobile application ("App") designed to monitor, record, and report head impact events in athletic and industrial environments. Our services include:

• Real-time impact detection and severity scoring via the IMPACT sensor.
• Wireless transmission of impact data to the Impulse mobile platform over Bluetooth 5.0.
• Dashboard reporting for coaches, medical staff, and safety officers.
• Historical session data and athlete-level analytics.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

You must be at least 18 years of age to create an account and enter into these Terms. If you are registering on behalf of a minor (such as a youth athlete), you represent that you are the parent or legal guardian of that minor and accept these Terms on their behalf.

Organizations using our services must ensure that all users accessing the platform are appropriately authorized and that any required parental consents are obtained before minors use the service.

To use certain features, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept responsibility for all activity under your account.
• Notify us immediately of any unauthorized use of your account at tech@impulsehit.com.
• Not share your account credentials with any unauthorized person.

We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.

You agree not to use our products or services to:

• Violate any applicable local, state, national, or international law or regulation.
• Reverse-engineer, decompile, or disassemble the IMPACT sensor hardware or software.
• Interfere with or disrupt the integrity or performance of our services or infrastructure.
• Attempt to gain unauthorized access to any portion of our systems or networks.
• Use impact data to make definitive medical diagnoses without the involvement of a qualified healthcare professional.

Impulse data is intended as an informational tool to support — not replace — professional medical judgment.

All hardware designs, software, algorithms, trademarks, trade names, logos, and content associated with IMPACT by Impulse are the exclusive property of Impulse Tech Inc. or its licensors. Nothing in these Terms grants you any right to use our intellectual property other than as strictly necessary to use our products and services as intended.

You retain ownership of any data generated by your use of our services (such as your organization's impact records), subject to our Privacy Policy.

Our products and services are provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Impulse disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Impulse does not warrant that the IMPACT sensor will detect every head impact event, that sensor readings will be error-free, or that the service will be uninterrupted or free of defects.

To the maximum extent permitted by applicable law, Impulse Tech Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use our products or services.

In no event shall our total aggregate liability to you exceed the amount you paid to Impulse in the twelve (12) months preceding the claim giving rise to liability.

You agree to indemnify, defend, and hold harmless Impulse Tech Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our products or services, your violation of these Terms, or your infringement of any third-party rights.

We may suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use our services will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and liability limitations) shall remain in effect.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page with an updated date. Your continued use of our products or services after the effective date of any changes constitutes your acceptance of the revised Terms.
